Terms of Use

1. General Conditions

The Photoskop project ("Photoskop") provides free educational content in the field of photography. Anyone can contribute to the project by submitting the original educational, artistic or other material in various formats, such as photographs, text, sketches, videos, animation, etc ("contributed content").
The results of the joint work of the Photoskop team and external authors (Contributors) is displayed to the photographic community ("Users") in a form of interactive lessons. By using this website or submitting the contribution content all parties agree to be bound by these Terms of Use and Privacy policy and undertake to comply with the Terms. If you disagree with any part of the Terms, do not access or use this website.

2. Rights

Contributors retain full rights to the content existing prior to submission. The Photoskop does not claim authorship / exclusive right to any content submitted by Contributors. By submitting a contributed content you hereby grant to the Photoskop open, non-exclusive, royalty-free, sub-licensable worldwide license to use the corresponding content in any manner not contrary to the applicable law for the purpose of creating educational materials, including the right to rework the content, except commercial usage. The license remains effective until terminated by the mutual consent of the parties as set forth in Article 3.7 of the present Terms.
By submitting a contributed content you hereby acknowledge that you own all exclusive rights to the respective content or are entitled to grant the rights to use the said content to the third parties. You hereby confirm that the content submitted by you does not violate the rights of the third parties, including intellectual property rights and personal non-property rights.

3. Contributors to the Photoskop project can:

  • 3.1. Submit a contribution as raw photographs, processed photographs, texts, or sketches of general ideas to the Photoskop project.
  • 3.2. Cooperate with the Photoskop team to produce the final version of the content, which will be realized and displayed to users on the Photoskop website in a form of interactive lessons.
  • 3.3. Provide personal and promotional information, links to websites and portfolios, and other material on their personal page, if it is not unlawful, prohibited, offensive or unreasonable to post.
  • 3.4. Request modifications of the photographic, textual or other information related to the contributed content, if it is aimed to improve the quality of the material.
  • 3.5. Use the original version of the contributed content (existing prior to submission) for personal and other purposes, including commercial usage.
  • 3.6. Use the results which were built upon the original contributions by the Photoskop, or as they appear in interactive lessons on the Photoskop website, or in a similar form, for personal, educational and promotional purposes, except commercial usage, providing the attribution to the Photoskop project and a link to the Photoskop website.
  • 3.7. Request a withdrawal of the contributed content providing a reasonable explanation. This request can be made during a period of time of 4 months after the public release of the contributed content on the Photoskop website. After that time period, the possibility to remove the author's content expires. This is done to ensure the integrity of the content on the Photoskop website and other educational resources (e.g. if the content is a part of the established course or appears on a popular website).

4. Contributors are not allowed to:

  • 4.1. Use the results based on their contributions as they appear in interactive lessons on the Photoskop website, or in a similar form, for commercial usage.
  • 4.2. Use the website for any unlawful purposes or in furtherance of illegal activities.
  • 4.3. Submit a contributed content infringing intellectual property rights and personal non-property rights of the third parties.

5. The Photoskop team can:

  • 5.1. Use contributed content for educational, promotional or other purposes, except commercial usage, providing the attribution to the contributing author and/or a link to the author's website.
  • 5.2 Modify and build upon the submitted contributions to improve the quality of the content, which includes post-processing, rearrangement of the material, mark-up with textual information, and incorporation of other material, without permission from the contributed author. The Photoskop should notify the contributor about any substantial changes related to the contributed content.
  • 5.3. Allow users of the Photoskop to download and use the lesson content provided by the contributor under the conditions described in these terms of use.
  • 5.4. Remove the lessons based on the contributed content in the case of the alleged infringement of the rights of the third parties, complaints from the user’s community, rearrangement of the lessons database (e.g. cleaning thematically duplicated content). The Photoskop should notify the contributing author about the content removal beforehand.

6. Users of the Photoskop project can:

  • 6.1. Use the Photoskop website and interactive player.
  • 6.2. Download the photographic content from the lessons on Photoskop website for educational and personal purpose, except commercial usage.
  • 6.3. Distribute and share photographs on other websites or social networks providing the attribution to the Photoskop project and a link to the Photoskop website.
  • 6.4. Leave feedback, suggestions, complaints about the website content and receive the support from the Photoskop website.

7. Users are not allowed to:

  • 7.1. Use the photographic or any other content from the Photoskop website for commercial purposes.
  • 7.2. Modify or build upon the photographic any other content from the Photoskop website

8. Waiver

To the extent permitted by applicable law, in no event shall the Photoskop, its affiliates, employees, or its licensees or partners, be liable to you for any loss of profits, use, or data, or for any incidental, indirect, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, however arising, that result from the use, disclosure, or display of content which has been submitted by you to the website, in case such use / disclosure / display complies with the terms of the license granted to the Photoskop and the present Terms.
In case of a dispute between you and another user in regard of the contributed content or IP rights infringement, such dispute shall be settled between users directly without any involvement of the Photoskop. In situations described above users cannot claim reimbursement of caused damages from the Photoskop. You hereby agree to indemnify and hold the Photoskop harmless from any claim or demand of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, your connection to the website, your violation of the present Terms and Privacy policy, or your violation of any rights of third parties. Such indemnification extends to liability arising from copyright infringement, trademark infringement, or the infringement of any intellectual property right.

In case of a dispute between you and another user in regard of the contributed content or IP rights infringement, such dispute shall be settled between users directly without any involvement of the Photoskop. The Photoskop may update these terms. The Photoskop undertakes to notify all contributors and registered users about any significant changes by sending a notification email.
